Please read these Terms and Conditions ("Terms," "Terms and Conditions") carefully before using the Variabl desktop application and website (the "Service") operated by Variabl ("us," "we," or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.
Variabl is a digital signage application that allows users to display and rotate web-based content — including dashboards, business applications, and websites — across one or more screens. The Service includes fullscreen display, smooth transitions between content sources, remote screen management, content scheduling, and playlist creation. The Service is offered on a subscription basis with a free trial period; no permanent free tier is available.
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password or credentials that you use to access the Service and for any activities or actions under your account. We may use third-party authentication providers, including Google Sign-In and Firebase Authentication; by using these features, you agree to comply with the applicable third party's terms of service.
Publicity and Marketing: By creating an account using a corporate or company email address, you grant Variabl, its affiliates, and allied companies under the same corporate umbrella (such as Tab Revolver) a non-exclusive, royalty-free, worldwide license to use your company's name, logo, and trademarks for promotional, marketing, and publicity purposes, including displaying them on our websites and marketing materials as a user of our services.
The Service is billed on a subscription basis ("Subscription(s)"), in advance, on a recurring and periodic basis (such as monthly or annually), depending on the plan you select.
The Service and its original content, features, and functionality are and will remain the exclusive property of Variabl and its licensors.
You are solely responsible for the content you choose to display through the Service, including ensuring you have all necessary rights and permissions to display it. Where the Service is used to display content from third-party applications (such as Power BI, Google Workspace, Grafana, or similar services), you are responsible for complying with the terms of service of those third parties. Variabl is not responsible for the availability, accuracy, or content of any third-party service displayed through the Service, and does not warrant that such third-party content will display correctly, continuously, or without interruption.
You agree strictly NOT to use the Service for:
In no event shall Variabl, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages — including without limitation loss of profits, data, use, goodwill, other intangible losses, or business interruption arising from display downtime — resulting from (i) your access to or use of, or inability to access or use, the Service; (ii) any conduct or content of any third party on the Service, including content displayed via third-party integrations; (iii) any content obtained through the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content — whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been informed of the possibility of such damage.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
These Terms shall be governed and construed in accordance with the laws of India, Telangana, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
